Welcome to ParkZapp™, a platform developed and owned by Zamorins Solutions, Inc. ("Zamorins Solutions," "we," "us," or "our"), to conduct and manage playground and park inspections and audits remotely and in the field based on ASTM and NRPA standards. ParkZapp makes inspections easy and compliant.

This Privacy Policy explains how we collect, use, share, and protect information you provide when you access and use the ParkZapp platform through our desktop services, mobile services, and web site, to use our APIs, applications, widgets, or other software provided on or in connection with our platforms and services, which we will refer to collectively as the ParkZapp Services or Services in this Policy, and your choices about the collection and use of your information. In order to use the Services, you must agree to this Policy.

1. WHAT INFORMATION IS COLLECTED BY US

The following types of information are collected by us.

  • A. INFORMATION YOU PROVIDE DIRECTLY TO US

We collect information when you first register for an account, which includes your name, phone number, address, email, other information during registration and that will improve your experience with the Services. This information, sometimes referred to as personally identifiable information, can be updated through your account. We use your email to contact you about changes to the Services, including additional features and updates. We will also use your email to send you billing information and other confirmation emails. In order to setup payment for your account, we also collect credit card or debit card information, as well as the related contact information in order to process the payments. We collect the information that you contribute through the Services, including the details of the inspections you complete in order to identify defective equipment and other systemic problems presented through the aggregation of data, as well as to improve the Services. We establish and collect a username and password that is used to access the Services.

  • B. ANALYTICAL INFORMATION

We use analytical tools to help us measure the traffic and usage trends on the Services. These analytical tools work by collecting information sent by your device(s) or our Services that assist us in improving the Services.

  • C. COOKIES, LOG FILES, AND DO NOT TRACK SIGNALS

When you access and use the Services, we may use cookies or similar technologies to collect information about how you use the Services in order to provide improved features to you. Some features of the Services may be impaired or disabled if cookies are disabled.

Additionally, your browser will automatically create log file information each time you request to visit a website or web application. Log file information can also be created when content from a webpage or web application is downloaded by your browser or device. When you use our Services, our servers automatically record certain log file information. This information can include the web request, the Internet Protocol address or IP address, browser type, referring or exist page and URL, the number of clicks and how you interact with the Services, domain pages, landing pages, pages viewed, and other information related to the Services. We may also use this information from emails that we send to you in order to determine what emails are opened and what links are clicked within particular emails. The collection of this information allows us to collect more accurate information to use for improving the Services.

We are unable to honor Do Not Track signals or headers because they would inhibit our ability to deliver and improve the Services.

  • D. DEVICE IDENTIFIERS

Device identifiers are files or similar data structures that are stored or associated with your mobile devices, such as your tablet or phone, which are used to uniquely identify that particular mobile device. A device identifier may be associated with hardware within the device or the operating system of the device.

When you use your mobile device to access the Services we may monitor, access, collect, monitor, on your device, or remotely store on your device one or more device identifiers. We use device identifiers to collect information about how you use the Services, which allows us to improve the Services. If device identifiers are disabled on your mobile device it may impair or disable some of the Services' features.

  • E. METADATA

Metadata is commonly viewed as the technical data that is associated with Content, for instance it describes how, when, and by whom a piece of Content was collected and how that Content is formatted. We may collect the metadata inherently included in your Content or actively added by you through geotagging, textual inputs, hashtags, and the like. The collected metadata is used as part of the Services functionality and we may also use it to improve the features available through the Services.

2. HOW INFORMATION IS USED BY US

In addition to the specific uses of information we detail this Privacy Policy, we may also use information to:

  • store account information so you will not have to reenter your account details when you visit the ParkZapp Services;
  • allow you to efficiently access information after you log into your account;
  • provide content and information to you that is personalized;
  • improve the Services by monitoring, testing, diagnosing, repairing, and updating the Services, which can include developing and testing new features and products, as well as updating the website or mobile application related to the Services;
  • and monitor metrics on an individual and aggregate basis, e.g. site traffic and demographics.

  • 3. HOW YOUR INFORMATION IS SHARED

    We will not rent or sell your information to third parties outside of Zamorins Solutions without your consent. We will only share your information with outside sources as set forth within this Policy.

    • A. PARTIES WE MAY SHARE YOUR INFORMATION WITH

    We may share Content and your information, including but not limited to, cookie information, log files, device identifiers, location data, and usage data, with businesses that are legally part of the same group of companies that Zamorins Solutions is part of, or that become part of that group referred to as our Affiliates. Affiliates may use this information to help provide, understand, and improve the Services, which may include providing analytical data and analytical reports to Affiliates' own services.

    We also may share your information, cookie information, log files, device identifiers, and location data, and usage data, with third-party organizations, or Service Providers that help us provide the Services to you, including Google for the purpose of incorporating Google AdSense into the Services. Our Service Providers will be provided access to your information only as is reasonably necessary to provide the Services under reasonable confidentiality terms. This may include combining your information with others in an aggregate, anonymized fashion.

    • B. WHAT OCCURS IF PARKZAPP CHANGES CONTROL

    If we sell or transfer part or all the Services or our assets to another organization, for instance in the course of a merger, dissolution, or acquisition, or the like, your information and any other information and Content collected through or contributed to the Services may be among the items sold or transferred. The buyer or transferee will have to honor our commitments to you that we have made in this Policy.

    • C. RESPONSES TO PREVENT HARM AND LEGAL REQUESTS

    In the event that we receive a legal request, such as a warrant, court order, or subpoena, we may access, preserve, or share your information or any other information and Content collected through or contributed to the Services in response, if we have a good faith belief that the law requires us to do so. This may mean that we respond to requests made from outside the United States, if we have a good faith belief the response is required by the law in that jurisdiction, affects individuals in that jurisdiction, and is consistent with international standards.

    We may also access, preserve, or share your information or any other information and Content collected through or contributed to the Services when we have a good faith belief that it is necessary to detect, prevent, or address fraud or other illegal activity, or to protect ourselves, you, or others, including as part of an investigation, or to prevent death or imminent bodily harm.

    Information we receive about you may be accessed, processed, and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

    4. HOW YOUR INFORMATION IS STORED

    We store and process your information and Content in the United States and any other country that we, our Affiliates, or our Service Providers keep facilities. In doing so, we may transfer information that we collect about you, including personal information across borders and around the world. Note that we may transfer information to a country that does not have the same data protection laws as your jurisdiction. Your registration, access, and continued use of the Services is your consent to the transfer of information to any of the locations we, our Affiliates, or our Service Providers keep facilities.

    Our Services use commercially reasonable safeguards to protect the information we collect through the Services. We also take reasonable steps to verify and identify you before we grant access to your account. We cannot guarantee, however, that the security of any information you transmit or guarantee that the information on the Services may not be accessed, altered, disclosed, or destroyed. We ask that you help us protect our Services and your account. Please be responsible for maintaining a secret and secure password that is unique for your account, at all times. We are not responsible for the functionality, privacy, or security measures of any service used in conjunction with the Services.

    5. MAINTAINING YOUR INFORMATION

    You may update your account at any time by logging in and changing your profile within your account settings. You may also opt-out of receiving emails from us by using the "unsubscribe" link provided in the messages you receive. After your account is closed with us, we may retain some or all of your information for a commercially reasonable amount of time for backup, archival, developmental, or audit purposes.

    6. INFORMATION ON CHILDREN UNDER 13

    We do not knowingly collect or solicit information from anyone under the age of 13 or allow them to register or use the Services. Our Terms of Use prohibit such individuals from using the Services. The Services and its content are not directed at or intended for children under the age of 13. In the event that we learn that we have collected personal information from a child under the age of 13 without parental consent, we will delete that information as soon as possible. If you believe that we might have any information from or about a child under 13, please contact us as indicated in Section 8 of the Policy.

    7. THIRD-PARTY SERVICES

    We are not responsible for any third-party service, web site, platform, or application used in conjunction with the Services. Please remember that our Privacy Policy and Terms of Use do not apply to third-party services. Your use and interaction of those third-party services through the Services are subject to their policies and rules. In addition, you agree that we are not responsible and do not have control over any third-parties or the content that is integrated into the Content of our Services.
